Creates section 403.7047 to regulate fossil fuel combustion products, defining beneficial uses including asphalt/concrete products, structural fill, pavement aggregate, and flue-gas emission control materials meeting specified environmental standards.

Exempts fossil fuel combustion products used beneficially from solid and hazardous waste regulation, provided storage complies with department rules and does not pose significant health or environmental risks.

Requires written notice to the Department of Environmental Protection for structural fill or pavement aggregate uses, specifying placement locations must be at least 3 feet from groundwater, 15 feet from wetlands, and 100 feet from potable wells.

Amends section 403.7222 to exclude disposal facilities accepting fly ash, bottom ash, boiler slag, or flue-gas emission control materials from fossil fuel-fired power plants from hazardous waste landfill restrictions.

Takes effect July 1, 2013.
