Creates Section 316.3035, Florida Statutes to establish a vehicular homicide offense for motor vehicle operators who cause death while using wireless communications devices to send or receive text messages.

Defines "wireless communications device" as any device designed to receive or transmit text or character-based messages, access or store data, or connect to the Internet or communications services allowing text communications.

Exempts emergency use of wireless communications devices, including emergency calls to law enforcement agencies, health care providers, fire departments, or other emergency services.

Establishes that violation of this provision constitutes vehicular homicide as defined in Section 782.071, Florida Statutes.

Takes effect July 1, 2013.
