Creates a public records exemption for proprietary confidential business information held by electric utilities during due diligence reviews of electric projects or fuel/renewable energy resource projects.

Defines proprietary confidential business information to include trade secrets, internal audits, security measures, bid/contractual data, and competitive information that would cause harm if disclosed.

Requires electric utilities to retain exempt information for one year after completing the due diligence review and deciding whether to participate in the project.

Exemption automatically repeals on October 2, 2018, unless the Legislature reviews and reenacts it under the Open Government Sunset Review Act.

Effective date is July 1, 2013.
