Department of Transportation must adopt rules by July 1, 2014 governing how local governmental entities can use the department's excess fiber optic communication networks for nontransportation purposes.

Rules must comply with state law and applicable federal regulations governing federally-funded property.

If nontransportation use is permitted, rules must require an interlocal agreement defining usage parameters and preserving the department's right to terminate the agreement if the right-of-way is needed for transportation purposes.

Rules must establish a statewide policy consistent with federal regulations for federal-aid projects that includes a needs analysis requirement before considering any nontransportation use.

Act takes effect July 1, 2013.
