CS for CS for SB 844 Summary

• Requires Medicaid providers to report changes in ownership or principal positions (officers, directors, partners with 5%+ ownership) to the Agency for Health Care Administration within 30 days.

• Expands the agency's authority to enroll providers licensed in Florida who offer diagnostic services through telecommunications technology, in addition to providers within 50 miles of the state line.

• Revises overpayment and sanction procedures, including allowing providers to contest overpayment amounts through administrative hearings with stricter evidentiary standards requiring contemporaneous records presented during the audit process.

• Modifies payment withholding procedures by eliminating the requirement to place withheld payments in a suspended account and specifies that overpayment repayment arrangements must be made within 30 days of final order.

• Terminates the Medicaid and Public Assistance Fraud Strike Force and related interagency fraud detection agreements effective June 30, 2014.
