Creates the "Florida Unborn Victims of Violence Act" allowing prosecution of a separate offense when conduct violating Florida Criminal Code causes death or bodily injury to an unborn child, with the same punishment as if injury occurred to the mother.

Defines "unborn child" as a member of the species homo sapiens at any stage of development carried in the womb, and eliminates the requirement to prove knowledge of pregnancy or intent to harm the unborn child.

Prohibits death penalty for unborn child offenses and exempts prosecutions related to abortion with consent, medical treatment of pregnant women or unborn children, and actions by the pregnant woman herself.

Replaces the term "viable fetus" with "unborn child" throughout Florida statutes governing driving under the influence, vehicular homicide, killing of unborn child by injury to mother, employment background screening, and criminal offense severity rankings.

Takes effect October 1, 2013.
