• Creates Part XI of Chapter 400 establishing licensure requirements for transitional living facilities serving individuals with brain and spinal cord injuries, including admission criteria, treatment plans, staff training, restraint/seclusion policies, and client rights protections.

• Expands Medicaid managed care requirements for HIV/AIDS patients to be assigned to specialty plans through university-based teaching organizations, and requires managed care plans to permit continued coverage for drugs removed from formularies when medically necessary.

• Modifies assisted living facility regulations including extended congregate care licensing, limited mental health licensing (now requiring one or more mental health residents), inspection frequency, violation penalties with increased fine amounts based on facility bed size, and consumer information disclosure requirements.

• Updates references to accrediting organizations statewide (Joint Commission, American Osteopathic Association/Healthcare Facilities Accreditation Program, and nationally-recognized organizations approved by CMS) and removes obsolete provisions related to stroke centers and trauma center assessments.

• Establishes state preemption over pharmacy and pain-management clinic regulation, exempts certain home dialysis services and hospital dialysis from licensure, allows driver license photo sharing for background screening verification, and adds disqualifying criminal offenses for background screening requirements.
