Creates section 836.12 of Florida Statutes requiring website operators to remove names and personal information (including photographs or digital images) of persons charged with crimes within 15 days of written notification if the person is acquitted, charges are dropped, or resolved without conviction.

Removal of information must be provided at no charge to the person requesting it.

Website operators who fail to remove information face a civil penalty of $100 per instance per week.

After 45 days of non-compliance, failure to remove creates a presumption of defamation of character.

Effective date: October 1, 2013.
