Exempts financial statements that governmental entities require prospective bidders to submit when bidding in response to invitations to bid, letters of interest, or requests for proposals and invitations to negotiate in public procurements from public records requirements.

Exempts financial information that governmental entities require persons to submit when responding to any solicitation, with an exception that this exemption does not apply to publicly traded companies and nonprofit organizations.

Establishes that the exemption is subject to the Open Government Sunset Review Act and shall automatically repeal on October 2, 2018, unless the Legislature reenacts it.

Declares a public necessity finding that financial disclosure of prospective bidders creates an unfair business advantage for competing firms and allows private companies to bid without concern that competitors could access their financial records.

Takes effect October 1, 2013.
