Requires health care practitioners present when an infant is born alive during or after an attempted abortion to exercise the same professional skill and care to preserve the infant's life and health as they would for any other infant of the same gestational age.

Mandates immediate transport and admission of infants born alive during or after an attempted abortion to a hospital, and requires health care practitioners and certain employees to report violations to the Department of Health.

Establishes violation of these provisions as a first-degree misdemeanor and clarifies that the law does not affect legal status or rights prior to being born alive.
