SB 1668 Summary

• Creates requirements for level 2 background screening of direct service transit providers and volunteers who provide paratransit services to elderly persons and those with disabilities, including employment history and local criminal records checks.

• Requires immediate dismissal of providers or volunteers who refuse screening, and authorizes license revocation and contract termination for employers who fail to dismiss noncompliant employees.

• Mandates that individuals serving as direct service transit providers on July 31, 2013 complete screening by July 1, 2014, with the Agency for Persons with Disabilities authorized to phase in implementation over the one-year period.

• Establishes disqualifying offenses beyond those in chapter 435, including Medicaid fraud, mail/wire fraud, identity theft, forgery, and insurance fraud convictions or guilty pleas.

• Requires rescreening every 5 years unless fingerprints are continuously retained in the federal fingerprint retention program, and directs providers to bear all screening costs.
