Creates exemption from public records requirements for trade secrets in hydraulic fracturing treatment information submitted to the Department of Environmental Protection's online chemical registry.

Requires persons submitting information to request confidential status and explain the basis for claiming trade secret protection; the department determines whether information qualifies as a trade secret after notice and opportunity for hearing.

Allows disclosure of trade secrets to authorized division representatives and other governmental entities for performance of duties or when relevant in proceedings, with recipients required to maintain confidentiality.

Exemption sunsets October 2, 2018, unless the Legislature reviews and reenacts the provision under the Open Government Sunset Review Act.

Takes effect on the same date as SB 1028 or similar legislation if adopted in the same legislative session and becomes law.
