CS for SB 1842 - Health Insurance Summary

• Establishes Florida Insurance Code compliance with the Patient Protection and Affordable Care Act (PPACA) and authorizes the Office of Insurance Regulation to review forms and conduct market examinations for PPACA compliance, with authority to report violations to the federal Department of Health and Human Services.

• Creates a navigator registration system under the Department of Financial Services requiring individuals to register before acting as navigators; includes criminal background checks, $50 application fees, qualifications standards, and grounds for denial or revocation of registration.

• Separates rating experience between grandfathered and nongrandfathered health plans; exempts nongrandfathered health plans from rate review and approval for plan years 2014-2015 and requires insurers to provide notices explaining PPACA's estimated premium impact.

• Terminates the Florida Comprehensive Health Association coverage on June 30, 2014; requires the association to assist policyholders in obtaining alternative coverage and complete dissolution by September 1, 2015.

• Appropriates $106,658 in recurring funds and $70,000 in nonrecurring funds plus two full-time positions to the Department of Financial Services to implement navigator registration provisions.
