SPB 7010 - Assisted Living Facilities

• Medicaid prepaid behavioral health plans become responsible for enrolled mental health residents in assisted living facilities with limited mental health licenses, while managing entities handle non-enrolled residents.

• Case managers must maintain records of face-to-face interactions with mental health residents for at least 2 years and ensure community living support plans are updated when significant behavioral health changes occur.

• Extended congregate care licenses require facilities to have 2 or more years of operation; initial licenses for newer facilities are provisional for 6 months and require unannounced inspections once extended congregate care residents are admitted.

• Administrative fines are restructured with fixed amounts based on facility bed count: Class I violations ($7,500 for <100 beds, $11,250 for ≥100 beds), Class II violations ($3,000/$4,500), Class III violations ($750/$1,125), and Class IV violations ($150/$225), with doubled fines for repeat violations.

• All newly hired assisted living facility employees must complete a minimum 2-hour preservice orientation before interacting with residents, with employee and administrator affidavit required; Agency for Health Care Administration must develop a consumer rating system and website content for assisted living facilities by January 1, 2014.
