SPB 7052 - Clerks of Court Summary

• Transfers the Clerks of the Court Trust Fund from the Justice Administrative Commission to the Department of Revenue effective upon the act becoming law.

• Revises filing fee distributions for circuit and county court proceedings, redirecting portions to the Clerks of the Court Trust Fund and reducing amounts to the General Revenue Fund and Administrative Trust Fund.

• Establishes new budget procedures requiring clerks to submit proposed budgets by June 1 each year to the Florida Clerks of Court Operations Corporation, with the Legislative Budget Commission reviewing and approving combined or individual clerk budgets by October 1.

• Requires clerks to remit monthly fines, fees, service charges, and costs exceeding one-twelfth of their annual budget to the Clerks of the Court Trust Fund, with annual excess remissions to the General Revenue Fund starting January 25, 2015.

• Sets authorized budgets for clerks of circuit court at $110,845,078 for July-September 2013 and $443,380,312 for the county fiscal year beginning October 1, 2013, with the corporation determining individual clerk allocations.
