Personal identifying information of participants in a yellow dot critical motorist medical information program held by counties is exempt from public records disclosure under Florida Statutes s. 119.07(1) and Article I, Section 24(a) of the State Constitution.

Emergency medical responders and law enforcement agents may access information provided in yellow dot folders to ensure rapid and effective treatment for serious traffic accident victims.

The exemption is subject to the Open Government Sunset Review Act and shall automatically repeal on October 2, 2019, unless the Legislature reviews and reenacts it.

The Legislature finds that protecting participant information prevents privacy invasion and protects program participants from robbery, burglary, and illicit drug activities, with harms from disclosure outweighing minimal public benefit.

The act takes effect upon enactment of HB 17 or similar legislation authorizing county governing bodies to create a yellow dot critical motorist medical information program in the same legislative session.
