Establishes penalties for possession of spiny lobster during closed season or possession of wrung/separated lobster tails while on water, classified as a major violation.

First violation is a second-degree misdemeanor; if 25 or more lobster are involved, it becomes a first-degree misdemeanor.

Second violation is a first-degree misdemeanor with up to 90-day suspension of all fishing licenses.

Third violation is a first-degree misdemeanor with mandatory 6-month minimum imprisonment, up to $2,500 civil penalty, and up to 6-month license suspension; third violation within 1 year of second violation becomes a third-degree felony with 1-year mandatory minimum imprisonment, $5,000 penalty, and permanent license revocation.

Fourth or subsequent violations are third-degree felonies with 1-year mandatory minimum imprisonment, $5,000 civil penalty, and permanent license revocation; also updates cross-reference in section 379.401 and takes effect July 1, 2014.
