CS/CS/HB 151 - Keeping I.D. Safe (KIDS) Act

• Authorizes parents and legal guardians to place security freezes on consumer reports for minors under 16 years of age, preventing consumer reporting agencies from releasing credit information without express written authorization.

• Requires consumer reporting agencies to place security freezes within 30 days of confirming request authenticity and to establish records for consumers with no existing credit history.

• Allows reasonable fees up to $10 for placing or removing a security freeze, with no fee charged for identity theft victims who submit law enforcement documentation.

• Mandates written notification to representatives within 10 business days of freeze placement, within 5 business days if a freeze is violated, and within 30 days of changes to name, address, date of birth, or social security number.

• Establishes administrative penalties of $500 per willful violation, civil liability of up to $1,000 for unauthorized access to consumer reports, and requires consumer reporting agencies to provide written disclosure of security freeze rights; effective September 1, 2014.
