Exempts trade secrets relating to hydraulic fracturing treatments from public records disclosure requirements in the Department of Environmental Protection's online hydraulic fracturing chemical registry, if the submitter requests confidentiality, provides basis for the trade secret claim, and marks documents as "trade secret"

Requires the department to promptly notify the trade secret submitter when a public records request is received, giving them 30 days to file a circuit court action to determine if the document contains trade secrets; failure to file within 30 days waives confidentiality and requires release

Permits disclosure of trade secrets to other governmental entities performing statutory duties and when relevant in proceedings under this statute, with all participants required to maintain confidentiality

Exemption automatically repeals on October 2, 2019, under the Open Government Sunset Review Act unless the Legislature reenacts it

Takes effect contingent upon HB 71 or similar legislation becoming law in the same legislative session
