CS/CS/HB 195 - Education Data Privacy Summary

• Requires schools to provide annual notice to K-12 students and parents of their rights under the Family Educational Rights and Privacy Act (FERPA).

• Prohibits collection, retention, or obtaining of information regarding political affiliation, voting history, religious affiliation, or biometric information (fingerprints, facial recognition, iris scans, voice prints, etc.) of students, parents, or siblings.

• Restricts disclosure of confidential and exempt student records to individuals, public bodies, and federal agencies except when authorized by law, required by federal regulation, or pursuant to lawfully issued subpoenas or court orders.

• Requires governing boards to designate directory information only in accordance with federal law at regularly scheduled meetings and must consider whether such designation puts students at risk of marketing campaigns, media attention, or criminal acts; allows charging fees for directory information copies.

• Requires the Department of Education to establish a process for assigning Florida student identification numbers separate from social security numbers; school districts may request but cannot require social security numbers as condition for enrollment or graduation.
