Motor vehicle operators must use federally approved child restraint devices for children 5 years of age or younger when transporting them on Florida roadways.

Children aged 3 years and younger must use a separate carrier or vehicle manufacturer's integrated child seat.

Children aged 4 through 5 years may use a separate carrier, integrated child seat, or child booster seat belt.

Child restraint requirements do not apply to children aged 4-5 when a safety belt is used and the child is being transported gratuitously by a non-family member, in a medical emergency, or has a documented medical condition requiring an exception.

Violations constitute a moving violation with 3 points assessed against the driver's license; violators may elect to complete an approved child restraint safety program to waive penalties and points at the court's discretion.
