County and municipal detention facilities are prohibited from electronically publishing arrest booking photographs of arrestees charged with, but not yet convicted of, a criminal offense.

The prohibition does not apply to electronic publication to governmental entities or third parties providing electronic criminal justice services to criminal justice agencies.

The sheriff or police chief, or their designee, may authorize publication to any entity if deemed necessary to protect public safety.

The bill does not restrict public access to records under Florida Statute 119.07.

The act takes effect October 1, 2014.
