CS/HB 463 - Background Screening Summary

• Authorizes Department of Highway Safety and Motor Vehicles to share driver license images with Department of Health and Agency for Health Care Administration for verifying photographs in the Care Provider Background Screening Clearinghouse.

• Exempts persons whose fingerprints are already enrolled in the Federal Bureau of Investigation's national retained print arrest notification program from submitting fingerprints again; requires electronic fingerprint submission for those without existing enrollment.

• Adds disqualifying offenses to background screening requirements, including Section 777.04 (attempts, solicitation, and conspiracy), Section 895.03 (racketeering), and Section 896.101 (money laundering).

• Establishes the Care Provider Background Screening Clearinghouse with requirements for fingerprint retention, photograph submission, and employer registration; mandates employers register and initiate criminal history checks through the clearinghouse before employees submit for electronic fingerprinting.

• Effective date: July 1, 2014.
