CS/HB 543 Summary

• Exempts unsolicited proposals submitted to state university boards of trustees from public records disclosure until the board announces an intended decision for a qualifying project.

• Creates three exemption timelines: proposals remain exempt until board notice of intended decision; if all proposals rejected and reissued, exempt until notice on reissued solicitation; or 180 days after receipt if no competitive solicitation is issued.

• Exempts meetings where exempt unsolicited proposals are discussed from public meeting requirements, but requires complete recording of all exempt meeting portions.

• Exempts recordings and records generated during closed meetings from public disclosure under the same timeline limits as the proposals themselves, with maximum 90-day exemption after board rejects all proposals.

• Subjects exemption to sunset review and automatic repeal on October 2, 2019, unless reenacted by the Legislature; takes effect when HB 541 or similar legislation becomes law.
