CS/HB 751 - Telehealth

• Creates section 456.47, Florida Statutes, establishing regulatory framework for telehealth providers using synchronous or asynchronous telecommunications technology to deliver health care services including assessment, diagnosis, consultation, treatment, and monitoring.

• Establishes that telehealth providers must meet the same standard of care as in-person providers, but may conduct patient evaluations using telehealth without prior medical history research or physical examination.

• Requires out-of-state health care professionals to annually register with the applicable board or Department of Health for $75 fee, hold an active unencumbered license from another state, and have no disciplinary action taken in the prior 5 years.

• Prohibits registered telehealth providers from opening offices or providing in-person services in Florida, and requires immediate notification to the board of any license restrictions or disciplinary actions.

• Exempts out-of-state providers from registration if providing services in response to emergency medical conditions, no more than 10 times per calendar year, or in consultation with a Florida-licensed provider retaining ultimate authority.
