HB 1005 - Florida True Origin of Goods Act

• Creates Part VII of Chapter 501, Florida Statutes, establishing the "Florida True Origin of Goods Act" as a consumer protection measure supplemental to existing state and federal law.

• Requires owners and operators of websites or online services selling prescription medications, tobacco products, motor vehicle parts, or electronically distributing commercial recordings or audiovisual works to clearly disclose true name, physical address, and telephone number in readily accessible locations (home page, "about us," "contact us," or information pages).

• Defines "physical address" as a mailing address with zip code showing actual location, excluding post office boxes and email addresses.

• Establishes civil penalties of up to $2,500 for violations, with escalated penalties of $5,000 to $10,000 per day for failure to comply with injunctions or court orders.

• Classifies violations as deceptive and unfair trade practices under Part II of Chapter 501, allowing enforcement by state attorneys or the Department of Legal Affairs with recovery of attorney fees and expenses for prevailing parties; effective July 1, 2014.
