CS/CS/HB 1055 Summary

• Licensed septic tank contractors may perform maintenance and repair on drainfields of aerobic treatment unit systems that are not performance-based treatment systems.

• Property owners of owner-occupied single-family residences may be approved as maintenance entities for their own aerobic treatment unit systems upon manufacturer-certified training, exempt from contractor registration but subject to permitting requirements.

• Septic tank contractors approved by manufacturers cannot be denied access to aerobic treatment unit system training or spare parts, and replacement parts meeting manufacturer specifications can be used after the original warranty period.

• Existing onsite sewage treatment and disposal systems may be used as integral parts of sanitary sewer systems with Department of Environmental Protection approval, provided the existing septic tank is evaluated by a registered contractor to ensure it is not in failure.

• Effective date is July 1, 2014.
