CS/CS/HB 1225 - HIV Testing

• Adds new definition of "health care setting" (county health departments, hospitals, urgent care clinics, substance abuse treatment clinics, primary care settings, community clinics, mobile clinics, correctional facilities) and "nonhealth care setting" (community-based organizations, outreach settings, mobile vans dedicated solely to HIV testing).

• Differentiates consent and notification procedures: health care settings require notification that testing is planned with right to decline; nonhealth care settings require full informed consent with explanation of confidentiality rights.

• Requires all persons tested to be informed that positive results will be reported to county health department and directed to locations offering anonymous testing.

• Maintains exceptions to consent requirements for statutorily-mandated testing (pregnant women, inmates before release, prostitution convictions), medical emergencies, research, autopsies, sexual battery defendants, and occupational exposures to medical personnel.

• Effective date: July 1, 2014.
