Creates section 316.3035 of Florida Statutes to establish criminal penalties for causing death while operating a motor vehicle and using a wireless communications device in violation of section 316.305.

Defines "wireless communications device" with the same meaning as provided in section 316.305.

Establishes a second-degree felony charge, punishable under sections 775.082, 775.083, or 775.084, for causing death of a human being or viable fetus while using a wireless device while driving.

Elevates the offense to a first-degree felony if the driver knew or should have known an accident occurred and failed to provide information and render aid as required by section 316.062.

Takes effect July 1, 2014.
