• Requires prescribers to access the prescription drug monitoring program database and review a patient's controlled substance prescription history before initially prescribing controlled substances listed in schedules II, III, or IV.

• Establishes the database must comply with Health Insurance Portability and Accountability Act standards and relevant privacy/security laws, with reporting required within 7 days of dispensing controlled substances.

• Restricts program funding to federal grants or private funding only; prohibits state funds and prescription drug manufacturer funds from supporting the program.

• Authorizes the Department of Health to establish a direct-support organization to provide funding and assistance, with a board of directors appointed by the State Surgeon General and contracts requiring annual budget approval and independent financial audits.

• Makes failure to comply with database access requirements grounds for disciplinary action by regulatory boards, and establishes criminal penalties for willfully failing to report controlled substance dispensing.

• Effective date: July 1, 2014.
