HB 4009 Summary

• Repeals statutory provisions authorizing the use of traffic infraction detectors (red light cameras) by the Department of Highway Safety and Motor Vehicles, counties, and municipalities to enforce traffic signal violations.

• Eliminates definitions of "traffic infraction detector" and "local hearing officer" and removes related procedural requirements for installation, operation, and transitional implementation of these devices.

• Removes the $158 penalty provision for violations enforced by traffic infraction detectors, while maintaining the $158 penalty for the same violations when enforced by law enforcement officers in-person.

• Prohibits individuals and vendors from receiving commissions, per-ticket fees, or remuneration based on the number of violations detected through traffic infraction detectors.

• Exempts traffic signal violations enforced by traffic infraction enforcement officers from driver license point assessments and prohibits their use for setting motor vehicle insurance rates.
