HJR 7151 Summary

• Creates Section 28 of Article X of the Florida Constitution to reserve the power to authorize gambling expansion exclusively to Florida voters through constitutional amendment by initiative petition.

• Defines "expansion of gambling" as introducing gambling at any facility or location not lawfully conducting gambling as of March 4, 2014, or expressly authorized by 2014 legislative session, including new types or categories of gambling at existing facilities.

• Defines "gambling" to include Class III gaming under federal Indian Gaming Regulatory Act (house banking games, casino games, sports betting, pari-mutuel wagering, non-state lotteries, electronic gambling devices, and video lottery terminals).

• Preserves the Legislature's authority to restrict, regulate, or tax gambling activities by general law and does not affect Florida's authority to negotiate or maintain tribal-state gaming compacts.

• Requires voter approval through the next general election or earlier special election if authorized by law.
