Repeals sections 791.013, 791.02, and 791.03, eliminating previous sparkler testing, approval, and licensing requirements for manufacturers, distributors, and wholesalers.

Requires retailers and seasonal retailers to register annually with the Division of the State Fire Marshal, paying registration fees of $15 per location (retailers) or $200 (seasonal retailers) and maintaining $2 million in liability insurance.

Mandates retailers provide buyers with a signed disclaimer at point of sale confirming the buyer is at least 16 years old, has reviewed fireworks laws, and acknowledges the inherent dangers of fireworks use.

Establishes age restriction prohibiting sale of fireworks, sparklers, and novelties to persons under 16 years of age.

Updates safety standards from NFPA 1123 1995 Edition to 2014 Edition and authorizes counties and municipalities to regulate fireworks sales and use, including requiring verification of buyer eligibility for exemptions.
