CS for CS for SB 782 - Government Data Practices

• Requires state agencies that collect personal identification information through websites to post a privacy policy with specified minimum content including data collection practices, security measures, and public records disclosure policies.

• Mandates agencies using cookies on websites to inform users and request permission before installation, with an exception for temporary session cookies; users who decline cookies must still be granted website access.

• Dissolves the Center for Health Information and Policy Analysis and replaces it with a Florida Health Information Transparency Initiative requiring the Agency for Health Care Administration to make state health data accessible, searchable, and downloadable.

• Requires the Agency for Health Care Administration to provide public access to assisted living facility data by November 1, 2014, including facility information, violations, and inspection reports, and authorizes a monitored public comment webpage for facilities.

• Establishes procedures for physical destruction of records containing personal identification information after retention requirements are met, and requires OPPAGA to report on state agency personal data holdings by July 1, 2015.
