Creates new section 159.8105 requiring the Division of Bond Finance to review allocation of private activity bonds and determine availability of additional or reallocated bonds for water and sewage facilities.

Exempts from Public Service Commission regulation persons who resell water service to tenants or residents if the fee does not exceed actual purchase price plus up to 9 percent or the actual cost of meter reading and billing.

Establishes criteria for evaluating water and wastewater service quality based on secondary drinking water standards and compliance with governing rules, with commission authority to assess fines and reduce return on equity by up to 100 basis points for utilities failing to address deficiencies.

Authorizes utilities to recover prudently incurred costs to resolve water quality or wastewater service deficiencies through rate cases or separate proceedings, and permits creation of utility reserve funds and automatic rate adjustments for specified expenses including purchased water/sewer rates, electric power costs, taxes, permits, and compliance-related loan fees.

Allows water utilities to establish surcharges or automatic rate adjustment mechanisms to recover fixed costs of system improvement projects approved by the commission that achieve compliance with secondary drinking water standards, and removes restrictions preventing loans and grants to for-profit privately owned water systems.
