SB 1348 - Homeowners' Associations Summary

• Renames the "Division of Florida Condominiums, Timeshares, and Mobile Homes" to include "Homeowners' Associations" and establishes regulatory authority over homeowners' associations with powers to investigate complaints, impose penalties, and conduct enforcement proceedings.

• Creates the Office of the Community Association Ombudsman within the division to provide education, dispute resolution assistance, and election monitoring services for homeowners' association members and boards.

• Establishes annual fees of $4 per residential parcel for homeowners' associations operating more than two parcels, with penalties and loss of court standing for non-payment by March 1.

• Expands the division's investigative jurisdiction to include complaints about developer control, improper turnover, financial issues, elections, and record access; limits post-turnover investigations to these specific areas only.

• Amends homeowners' association governance provisions including ballot election procedures, proxy voting requirements, amendment voting thresholds, notice requirements for assessment increases, and restrictions on fines becoming liens.
