Authorizes impact fees to be used for providing, constructing, improving, repairing, altering, or replacing capital facilities including transportation, utilities, water and sewer systems, parks, libraries, educational facilities, and health systems.

Allows counties or municipalities to impose a discretionary surcharge on real property documents in lieu of impact fees, with a combined maximum rate of $1 per $100 of property consideration.

Requires surcharge ordinances to be proposed at least 2 weeks before adoption, explicitly state their purpose, and take effect 90 days after formal approval by majority vote of the governing authority.

Mandates the Department of Revenue to collect and remit surcharge revenues (minus administrative costs) to counties and municipalities, which must deposit funds into dedicated trust funds and report revenues and expenses annually.

Prohibits counties or municipalities from assessing both a surcharge and an impact fee for the same purpose while the surcharge is in effect.
