Health insurers and health maintenance organizations cannot require insureds or subscribers to obtain prescription drugs exclusively from mail order pharmacies.

Insureds who choose not to use mail order pharmacies cannot be charged higher copayments or have different conditions imposed if their chosen pharmacy agrees to the same terms and reimbursement rates as the mail order pharmacy.

Health insurers and HMOs must provide insureds and subscribers with an explanation comparing payment and reimbursement methods for mail order pharmacies versus other pharmaceutical providers, including in benefit booklets if applicable.

Mail order pharmacies under contract must disclose in initial written correspondence that subscribers may obtain pharmaceutical services from other providers and exclusive mail order use is not required.

Non-mail order pharmacies requesting to provide services must be given information about applicable terms and conditions, and if they agree in writing to the same terms and reimbursement rates as mail order pharmacies, they cannot be paid more than what mail order pharmacies receive.
