CS/HB 63 - Public-Private Partnerships Summary

• Transfers and renumbers section 287.05712 to section 255.065 of Florida Statutes, amending public-private partnership provisions

• Requires private entities submitting unsolicited proposals to pay an initial application fee with additional amounts if initial fee does not cover evaluation costs; payment must be made in cash, cashier's check, or noncancelable instrument

• Authorizes responsible public entities to alter the statutory timeframe for accepting proposals with majority vote approval and removes requirement for school board local governing body approval before entering comprehensive agreements

• Deletes provisions creating the Public-Private Partnership Guidelines Task Force and provisions requiring notice to affected local jurisdictions

• Restricts financing agreement provisions that could result in loss of public entity ownership of real or tangible personal property; requires private entity fees to be applied as set forth in comprehensive agreement; effective July 1, 2015
