CS/HB 65 Summary

• Exempts unsolicited proposals received by public entities from public records disclosure until the entity provides notice of an intended decision for a qualifying public-private partnership project.

• Exemption for unsolicited proposals expires after 90 days if the entity rejects all competitive solicitation proposals, or 180 days after receipt if no competitive solicitation is issued for the project.

• Exempts any meeting portion where exempt unsolicited proposals are discussed from public meeting requirements; requires complete recording of exempt meetings with no off-the-record portions.

• Meeting recordings and records generated during exempt discussions are protected from public disclosure under the same timeline as the proposals themselves.

• All exemptions subject to sunset review and automatically repeal on October 2, 2020, unless the Legislature reenacts them; effective date contingent on passage of HB 63 or similar legislation.
