HB 103 Summary

• Defines "violent felony" as felony offenses listed in s. 775.084(1)(c)1. or s. 948.06(8)(c) for purposes of the Victims of Wrongful Incarceration Compensation Act.

• Disqualifies persons from receiving wrongful incarceration compensation if they were convicted of, pled guilty to, or served concurrent time for another violent felony before or during the wrongful incarceration period.

• Makes wrongfully incarcerated persons ineligible for any compensation if they commit a violent felony violation resulting in revocation of parole or community supervision while serving the wrongful sentence.

• Requires petitioners seeking wrongful incarceration status to assert in court filings that they are not disqualified under the violent felony provisions.

• Takes effect October 1, 2015.
