CS/CS/CS/HB 175 - Computer Abuse and Data Recovery Act

• Creates the "Computer Abuse and Data Recovery Act" as part V of chapter 668, Florida Statutes, establishing civil liability for unauthorized computer access and data theft.

• Prohibits knowingly obtaining information from protected computers without authorization, transmitting programs or code without authorization, or trafficking in technological access barriers when intent to cause harm or loss is present.

• Establishes civil remedies including recovery of actual damages, lost profits, economic damages, violator's profits, injunctive relief, and recovery of misappropriated information, with reasonable attorney fees awarded to prevailing parties.

• Provides a 3-year statute of limitations for civil actions measured from when the violation occurred or was discovered or should have been discovered with due diligence.

• Exempts lawfully authorized law enforcement and regulatory agency activities, and prohibits imposing liability on interactive computer service providers, information service providers, and communications service providers for transmitting or storing third-party communications.
