CS/CS/HB 465 - Human Trafficking

• Enhances criminal penalties for soliciting another to commit prostitution, making it a first-degree misdemeanor for first offense, third-degree felony for second offense, and second-degree felony for third or subsequent offenses.

• Requires persons convicted of soliciting prostitution to perform 100 hours of community service and attend an education program about the negative effects of prostitution and human trafficking.

• Imposes a minimum mandatory 10-day incarceration period for second and subsequent violations of soliciting another to commit prostitution.

• Authorizes courts to impound or immobilize vehicles used in soliciting prostitution for up to 60 days, with exceptions for owners whose families lack transportation, vehicles that were stolen, recently purchased vehicles, or business-owned vehicles operated only by employees.

• Assesses a $5,000 civil penalty for soliciting prostitution violations, with proceeds funding drug court programs and safe houses for human trafficking victims.

• Allows human trafficking victims to file expunction petitions in any circuit court where arrested and permits advocates to be present during expunction hearings upon request.

• Effective date: October 1, 2015.
