Amends Florida Statute 790.01 to exempt persons from criminal penalties for carrying a concealed weapon or firearm while evacuating pursuant to a mandatory evacuation order during a declared state of emergency.

Defines "in the act of evacuating" as immediate and urgent movement away from an evacuation zone within 48 hours after a mandatory evacuation order is issued, with the 48-hour period extendable by Governor's executive order.

Applies exemption to persons carrying concealed weapons or to persons who may lawfully possess a firearm and carry it concealed during a mandatory evacuation declared by the Governor under chapter 252 or by a local authority under chapter 870.

Maintains existing exemptions for self-defense chemical sprays and nonlethal electric weapons or devices designed solely for defensive purposes.

Takes effect upon becoming law.
