CS/CS/HB 765 - Household Moving Services

• Requires movers to offer valuation coverage indemnifying shippers for at least the cost of repair or replacement of household goods, waivable only by signed or electronic acknowledgment in the service contract.

• Mandates physical surveys and binding estimates before moving services, with binding estimates provided at least 48 hours before scheduled shipment unless waived by the shipper in writing.

• Establishes maximum charges movers can collect before delivery equal to the binding estimate amount plus agreed-upon additional services and impracticable operations costs.

• Requires movers to tender household goods for delivery on the agreed date or within a specified timeframe unless waived; prohibits withholding prescription medicines or children's goods under any circumstances.

• Creates criminal penalties of felony third degree for refusing to relinquish household goods after payment is tendered or for failing to produce a signed estimate or contract; requires department to prepare consumer rights publication and adopt implementing rules; effective July 1, 2015.
