CS/HB 769 - Health Provider Contracts Summary

• Prohibits health insurers, prepaid limited health service organizations, and health maintenance organizations from requiring ophthalmologists, optometrists, or their third-party administrators to provide vision care services as a condition of providing other services.

• Prohibits these organizations from requiring ophthalmologists, optometrists, or opticians to purchase materials or services from entities in which the organization has direct or indirect ownership, financial, or controlling interest.

• Classifies violations as unfair insurance trade practices under section 626.9541(1)(d) and as unfair or deceptive acts or practices under the Florida Deceptive and Unfair Trade Practices Act, subjecting violators to civil and administrative action.

• Applies to all contracts entered into or renewed on or after July 1, 2015.

• Effective date: July 1, 2015.
