HB 793 Summary

• Retail sales establishments must grant cash or credit refunds within 3 days of purchase for goods exceeding $1,000 if the consumer is adjudicated incapacitated or has physician documentation of a medical condition causing inability to make reasonable decisions, or a representative provides such proof.

• Goods must be unused and in original carton, and the consumer or representative must provide proof of purchase to qualify for the mandatory refund.

• Violations of the mandatory refund requirement for incapacitated persons result in restitution plus an administrative fine equal to twice the value of refused goods.

• Retailers must post "no refund or exchange" signs at point of sale or default to a 7-day refund policy for unused merchandise in original carton.

• Act takes effect July 1, 2015, and applies only to amendments of section 501.142 relating to retail refund policies and conforming changes to gift certificate enforcement provisions.
