CS/HB 813 - Secondary Metals Recyclers

• Transfers administration of secondary metals recycler regulations (Chapter 538, Part II) from the Department of Revenue to the Department of Agriculture and Consumer Services.

• Requires secondary metals recycler applicants to submit fingerprints and pay fingerprint processing fees; fingerprints retained in national arrest notification program and searched against future arrests.

• Mandates $100,000 minimum general liability insurance coverage and active registration certificate before obtaining local business tax receipt.

• Prohibits purchase of regulated metals and ferrous metals on Sundays and between 7 p.m. and 7 a.m.; restricts purchases of specific items (utility poles, manhole covers, catalytic converters, etc.) without seller ownership verification.

• Provides $320,000 recurring and $190,000 nonrecurring appropriations to Department of Agriculture and Consumer Services for implementation; effective July 1, 2015.
