Department of Environmental Protection must submit state implementation plans relating to air pollutant standards to the Florida Legislature for ratification before submitting to the federal Environmental Protection Agency under the federal Clean Air Act, Title I, Part A.

Department may submit an initial plan to the federal EPA if legislative ratification would delay timely submission, provided it submits the plan to the Legislature at least 30 days prior and requests an extension from the EPA.

Initial plan submitted without ratification must include a statement that it has not been ratified by the Florida Legislature and that the Department may submit an additional filing pursuant to Florida law.

Legislative ratification requirement applies to all legally binding executive branch actions relating to implementation of federal EPA rules under the Clean Air Act, including executive orders, policies, guidance documents, and rulemaking.

Effective date is July 1, 2015.
