Authorizes commercial and industrial business owners or contracted third parties to install, maintain, and operate renewable energy source devices on their structures or owned/leased properties and sell the generated electricity to businesses on the same or contiguous parcels without being subject to utility regulation.

Allows electric utilities to enter into contracts to install, maintain, and operate renewable energy source devices on business structures and sell the electricity generated to those businesses under the same non-regulated conditions.

Permits utilities to recover actual costs for backup generation capacity and transmission services if energy-producing businesses require additional related services from the utility.

Allows the Florida Public Service Commission to approve utility requests to recover capacity, generation, and distribution costs if renewable energy use significantly reduces customer electricity purchases and adversely impacts rates for other customers, subject to super-majority commission approval and customer challenge procedures with refunds for excessive charges.

Clarifies that renewable energy rebate or incentive programs established by law are solely the property of the renewable energy device owner and cannot be claimed by customers purchasing electricity from that device unless they own the device themselves.

Effective date: July 1, 2015.
